United States v. Djoumessi
538 F.3d 547 (6th Cir. 2008)
The Sixth Circuit upheld Djoumessi's convictions under 18 U.S.C. § 1584 for holding a minor female in involuntary servitude and for harboring an alien for financial gain. Applying Kozminski, the court held that threats of deportation can constitute coercion through the legal process, and that even if the victim had opportunities to escape, involuntary labor during at least some portion of her stay suffices to sustain the conviction.
Rule cited
'Involuntary servitude' means forced labor through the use or threat of physical restraint or injury, or coercion through law or the legal process; threats of deportation can constitute such coercion, and involuntary labor during at least part of the victim's stay suffices to sustain a conviction.
Scope of application
Binding only within the Sixth Circuit as a criminal decision; it is not a nationwide administrative precedent for USCIS or EOIR, and the USCIS Policy Manual cites it only in involuntary servitude contexts.
