我们发布指南说明，2024 年 8 月 1 日或之后发生的未定性退役不符合前外籍服役人员根据《移民与国籍法》第 328 条和第 329 条入籍所需的“光荣条件”退役要求。
我们还宣布，将不再与美国海关与边境保护局协调在入境口岸进行入籍面谈和宣誓仪式。相反，居住在美国境外的外籍退伍军人必须寻求签证或入境许可（Parole）入境进行入籍面谈。
我们正在更新关于未定性退役的指南，以符合国防部指令（DODI）的变更，并与《移民与国籍法》第 328 条和第 329 条保持一致。2024 年 8 月 1 日，美国战争部修订了 DODI 1332.14《士兵行政分离》，删除了先前将“未定性”退役视为“行政事项”的“所需定性”的条款。该修订还将入门级分离列为独立于光荣退役和一般（光荣条件）退役的单独退役类别。
根据 DODI 的上述更新，根据《移民与国籍法》第 328 条和第 329 条申请入籍、且在 2024 年 8 月 1 日之前被给予未定性退役的外籍军人，符合入籍所需的“光荣条件”退役要求；而根据《移民与国籍法》第 328 条和第 329 条申请入籍、且在 2024 年 8 月 1 日或之后被给予未定性退役的外籍军人，则不符合入籍目的的“光荣条件”退役要求。
因未遵守 COVID 疫苗接种要求等原因而以低于光荣条件退役或分离的军人，可向战争部请求更改其“退役定性”。我们将依据前服役人员提交的官方退役文件，判断其是否光荣服役并以光荣条件退役。
根据第 14347 号行政命令《恢复美国战争部》（2025 年 9 月 5 日），该更新还将所有“国防部”替换为“战争部”。
美国移民局政策手册第 12 卷第 I 部分第 2、3 和 5 章的这些更新符合第 14148 号行政命令《初步撤销有害行政命令和行动》、第 14161 号行政命令《保护美国免受外国恐怖分子及其他国家安全和公共安全威胁》以及第 14184 号行政命令《恢复根据军队 COVID-19 疫苗接种强制令被退役的服役人员》。这些变更对于保护美国移民局军人福利入籍计划的含义、价值和完整性是必要的。
