Key changes
- U.S. Citizenship and Immigration Services (USCIS) is revising guidance in the USCIS Policy Manual regarding filing fees for L-1 petitions and the regulatory changes made by the 9-11 Response and Biometric Entry-Exit Fee for H-1B and L-1 Visas final rule (9-11 Biometric Fee final rule).
- Provides that the 9-11 Biometric Fee (also referred to as the Public Law 114-113 fee) applies to all L-1 petitions filed by covered employers except for amended petitions that do not request an extension of stay.
- Clarifies that part-time and full-time employees are included when calculating whether more than 50 percent of the petitioner’s employees, in the aggregate, are in H-1B or L-1 status.
- Removes the specific dollar amounts for the Fraud Prevention and Detection fee and the 9-11 Biometric Fee and instead refers to the Fee Schedule (G-1055) for all fee amounts.
