6 min readAdapted by TOP EASIER

USCIS announced on April 3, 2024, the restoration of 540-day automatic extensions for certain EAD categories. This article outlines the policy changes, lists eligible categories (including H-4 and pending adjustment of status), and explains the 180-day continued work authorization for STEM OPT extensions with legal citations and practical guidance.

[Updated April 3, 2024] USCIS issued a notice today restoring the 540-day automatic extension.

[Updated November 15, 2023] In late October, USCIS quietly updated its English-language EAD extension page, canceling the pandemic-era 540-day automatic extension and reverting to the prior policy: if an EAD renewal application is timely filed, the automatic extension is only 180 days. As of the update of this article, USCIS's Chinese-language page had not been updated and still stated 540 days.

[Updated May 4, 2022] On May 4, 2022, the Department of Homeland Security published a notice in the Federal Register adding 360 days to the 180-day automatic work authorization for EAD renewals, for a total of up to 540 days. During the pandemic, USCIS accumulated a large backlog of applications, and many people could not work because they did not receive EAD approvals in time; this adjustment by USCIS was at least a meaningful step.

An EAD renewal application can be filed no earlier than 180 days before the current card expires, and in recent years USCIS processing has slowed, sometimes taking six or seven months or even longer to approve. However, in the following situations, as long as a renewal application is filed before the current EAD expires, the applicant may automatically receive work authorization for up to 540 days while USCIS adjudicates the case.

Some EAD Categories Eligible for 540-Day Automatic Extension

For the following categories, the automatic extension period has changed from 180 days to 540 days. The legal basis is 8 CFR 274a.13(d)(1) and the updated 8 CFR 274a.13(d)(5): “Temporary increase in the automatic extension period. The authorized extension period […] is increased to up to 540 days for all eligible classes of aliens […].”

CategoryDescription
(a)(3)Refugee
(a)(5)Asylee
(a)(7)N-8 / N-9 special immigrant
(a)(8)Citizens of Micronesia, the Marshall Islands, and Palau
(a)(10)Person granted withholding of deportation
(a)(12)TPS (Temporary Protected Status)
(a)(17)Dependents of E visa holders
(c)(8)Pending asylum application
(c)(9)Pending adjustment of status
(c)(10)Person granted suspension or cancellation of removal
(c)(16)Adjustment of status under Creation of Record
(c)(19)Pending TPS application
(c)(20)Pending I-700 (temporary residence)
(c)(22)Pending I-687 (temporary residence)
(c)(24)LIFE Act immigrant
(c)(26)H-1B dependent (H-4)
(c)(31)VAWA applicant (victim of domestic violence)

For China-born applicants, the provisions most likely to apply are (c)(9) pending adjustment of status (I-485 filed and awaiting decision) and (c)(26) H-4; other possibly applicable categories include (a)(5) and (c)(8) political asylum, and (c)(31) domestic violence victims. The other categories are essentially irrelevant to the vast majority of China-born applicants.

STEM OPT Extension Allows Continued Employment for 180 Days

In addition, STEM OPT extensions can still continue work for up to 180 days, based on 8 CFR 274a.12(b)(6)(iv): An Employment Authorization Document, Form I-766 or successor form, under paragraph (c)(3)(i)(C) of this section based on a STEM Optional Practical Training extension, and whose timely filed Form I-765 or successor form is pending and employment authorization and accompanying Form I-766 or successor form issued under paragraph (c)(3)(i)(B) of this section have expired. Employment is authorized beginning on the expiration date of the Form I-766 or successor form issued under paragraph (c)(3)(i)(B) of this section and ending on the date of USCIS’ written decision on the current Form I-765 or successor form, but not to exceed 180 days. For this same period, such Form I-766 or successor form is automatically extended and is considered unexpired when combined with a Certificate of Eligibility for Nonimmigrant (F-1/M-1) Students, Form I-20 or successor form, endorsed by the Designated School Official recommending such an extension.

If the statutory language is difficult to understand, USCIS’s official website provides a clearer explanation: “If you file your STEM OPT extension application on time and your OPT period expires while your extension application is pending, we will automatically extend your employment authorization for 180 days. This automatic 180-day extension ceases once USCIS adjudicates your STEM OPT extension application.”

In this situation, when completing Form I-9, one need only provide the STEM extension I-20 and add 180 days to the original EAD expiration date; see the explanatory article by immigration attorney Giselle Carson on the legal Q&A website AVVO.
