Actual Passport Validity Requirements for B1/B2 Visa Extension Applications
This article clarifies the passport validity requirement for B1/B2 visa extensions: USCIS only requires the passport to be valid for the duration of stay, not for six months beyond departure. It cites the official website and a reader's call to USCIS, concluding that the passport need only be valid through the intended departure date.
I previously introduced the process for extending a B1/B2 visa, where I mentioned that the applicant's passport must be valid.
There is an online claim: at the intended departure date, the applicant's passport must not only be valid but also have at least six months of validity remaining; that is, if you apply to extend until June 1, 2018, your passport must be valid until at least December 1, 2018. An article on the legal website alllaw.com about extensions states:
The passport must remain valid for at least six months beyond your departure date.
Today, a reader named cliffoflove seems to have the same confusion, and she asked:
Our situation is rather special: we didn't carefully check my mother's passport validity before entry, and her passport expires in July this year, so the stay period granted by CBP at entry only extends to six months before the passport expiration, i.e., January. I applied for an extension for my mother until March (actual stay less than three months), which is only four months before the passport expiration. Based on your analysis, is there a high chance of approval for this kind of extension application where the stay period was not fully granted due to insufficient passport validity?
However, regarding extensions, USCIS has not said that 'the passport must have at least six months remaining'; its official extension application page requires:
Your passport is valid and will remain valid for the duration of your stay.
It only requires your passport to be valid during your stay, and does not require six months remaining.
Another reader, qiqi, discussed this issue with me before, and at that time she specifically called USCIS:
I have called USCIS. Regarding the passport issue, there is no 6 months requirement. Same answer as it shows on the website, 'Your passport is valid and will remain valid for the duration of your stay.'
My conclusion is: when applying for an extension, the passport only needs to be valid until the intended departure date. For example, if you apply for an extension to June 1, 2018, the passport must be valid at least until June 1, 2018, not necessarily until December 1, 2018.
