The Employment and Training Administration (ETA) published a 60-day notice in the Federal Register announcing a revision to the information collection for the Office of Foreign Labor Certification’s H-2B forms. The H-2B forms include the Form ETA-9142B, Application for Temporary Employment Certification, its accompanying appendices, related forms, and instructions (OMB Control Number 1205-0509).
OFLC seeks to renew the following forms without changes: Form ETA-9142B, Application for Temporary Employment Certification; Form ETA-9142B appendices, Appendix A - Additional Place(s) of Employment and Wage Information, Appendix C - Foreign Labor Recruiter Information , and Appendix D – Joint Employer/Job Contractor Information ; Form ETA-9142B, Final Determination ; Form ETA-9142B, Seafood Attestation ; and accompanying form instructions. A non-substantive change was made to update a footnote citation for Appendix B - Employer and Attorney/Agent Declaration for H-2B Employers to reflect the most recent appropriations bill.
OFLC has characterized this action as a revision, however, because OFLC seeks to eliminate the Form ETA-9155, H-2B Registration , and its accompanying instructions. The Form ETA-9155 was not implemented and is not in use.
The Federal Register notice informs the public of the request for three-year approval of the information collection under OMB Control Number 1205-0509 and invites comments from the public for 60 days.
